1. acceptance of the conditions

1.1 Overview

Welcome to PaarGespräch, an application (“App”) provided by Michael Wager. These Terms of Use (“Terms”) govern your access to and use of the App and all related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1.2 User authorization

“You” refers to the person using the App. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1.3 Changes to the conditions

We may update these Terms from time to time. Changes will be posted within the App and the “Last Updated” date will be adjusted accordingly. Your continued use of the app after the changes means that you accept the new terms.

PaarGespräch is your personal AI relationship assistant, available around the clock. Experience supportive conversations and gain valuable insights to improve your relationship. Key features include:

  • Instant access: AI-driven coaching sessions available anytime, anywhere.
  • Confidential conversations: Have supportive, non-judgmental conversations.
  • Personalized strategies: Get coping techniques and exercises/homework tailored to you.

Note: PaarGespräch does not replace professional couples counseling.

4.  Kontoanmeldung

4.1 Account creation

In order to access certain features, you may need to create an account. You agree to provide accurate information and to update it as necessary.

4.2 Account security

You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. Notify us immediately of any unauthorized use. 

5.  Abonnements und Zahlungen

5.1 Access levels

We offer:

  • Basic plan: Free access with limited functions.
  • CoupleCall Premium: Paid subscription with all functions.

5.2 Terms of payment

By subscribing to PaarGespräch Premium, you agree to pay the specified fees and applicable taxes. Payments are processed via Apple (iPhone/iPad), Google (Android) or Stripe/Paypal (web app).

5.3 Automatic renewal

Subscriptions are automatically renewed unless they are canceled before the renewal date.

5.4 Refund policy

All fees are subject to TODO’s refund policy. Please refer to TODO’s refund policy for more information. 

6.  Nutzerverhalten

6.1 Permitted use

You agree not to do the following:

  • Violate laws or regulations.
  • Publish harmful, obscene or infringing content.
  • Interfere with the operation or security of the app.
  • Engage in unauthorized data collection.
  • Use the app as a substitute for professional couples counseling.

7. copyrights

7.1 Ownership

All content and materials in the app are the property of Michael Wager and are protected by copyright laws.

7.2 User content

By submitting content, you grant us a non-exclusive, worldwide license to use, modify and display such content to provide our services.

8.  Dienste von Drittanbietern

The app may contain links to third-party websites or services. We are not responsible for their content or practices.
We work with the third-party provider OpenAI to provide our services. OpenAI processes certain data exclusively on our instructions and in accordance with strict data protection and security standards. Details can be found in our privacy policy. 

9.  Kündigung

We may suspend or terminate your access to the App at our sole discretion and without notice if your behavior violates these Terms.

10. Haftungsausschluss

The App is provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

10.1 Medical disclaimer

  • PaarGespräch is designed to offer relationship support based on AI, but is not a licensed medical or healthcare provider.
  • The app does not offer medical advice, diagnosis or treatment.
  • The content provided is for information purposes only and does not replace professional medical advice.
  • Always consult a qualified healthcare provider if you have questions about a medical condition.

The AI-supported online support offered by PaarGespräch is intended to provide general support with interpersonal and life-related issues. AI provides support in the context of general topics, but is not a substitute for professional psychotherapeutic interventions and therefore in no way replaces professional psychotherapy, medical treatment or counseling by qualified specialists such as psychologists, psychotherapists or psychiatrists.

  • No diagnoses or treatments:

AI-based counseling does not offer diagnoses, medical advice or psychotherapeutic treatment. It merely provides support in the context of general self-help.

  • No acute emergencies:
    In the event of acute mental crises, emergencies or suicidal thoughts, please seek professional help immediately from a doctor, therapist or contact an emergency call center
  • Professional advice:
    If you have mental health problems that require therapy or clinical care, please contact a licensed psychotherapist or healthcare professional.
  • Personal responsibility:
    The use of AI-supported advice is at your own risk. All information and recommendations provided here are to be understood as general information and not as binding, professional advice.
  • Minors:
    PaarGespräch is not a designated contact point for children and young people. In principle, PaarGespräch supports all enquirers as long as the purchase contract is valid.

11. limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages resulting from the use of the app.

11.1 Specific restrictions

  • We are not responsible for any decisions you make based on the information provided by the app.
  • We do not accept any liability for negative effects resulting from the use of the app.

12. changes to the app

We may change or discontinue the app or features at any time without notice.

13. Streitbeilegung

13.1 Arbitration proceedings

All disputes arising out of these Terms or the use of the App shall be settled by binding arbitration in accordance with the rules of the FRG.

13.2 Waiver of class actions

You agree to resolve disputes individually and not as part of a class action.

15. age restrictions

Users must be at least 12 years old to use the app. Users who have not yet reached the legal minimum age in their jurisdiction require parental consent. 

16. Verschiedenes

16.1 Severability clause

If any provision is declared unenforceable, the remaining provisions shall remain in force.

16.2 Entire agreement

These Terms constitute the entire agreement between you and Michael Wager with respect to the App.

Please note that the use of PairCall for iOS is subject to acceptance of the Apple Standard End User License Agreement.
